As regulators continue to refine how foreign firms access local markets, recent developments across Europe and Australia highlight a growing focus on market entry routes, supervisory oversight, and reporting frameworks. For fund managers and investment firms operating cross-border, understanding these mechanisms is increasingly central to maintaining compliant and efficient distribution strategies.

Italy – Investment Services
In addition to providing information on the cross-border distribution of investment funds, the Global Knowledge Hub also features information concerning the provision of investment services on a cross-border basis. In Italy, firms seeking to provide investment services or investment products must carefully assess whether it is possible to operate on a cross-border basis or whether the establishment of a local branch would be required.
In the recently published practical guidance, we clarify the conditions under which each route is available, as well as the supervisory and operational implications of each approach. Within the GKH, this is addressed through dedicated investment services content, helping firms determine the most appropriate pathway based on their business model and activities.
France – Regulatory Reporting and Market Transparency
In France, regulatory oversight continues to emphasise transparency and structured reporting for foreign market participants, and we have recently updated the Global Knowledge Hub with the latest requirements.
In 2025, the Autorité des Marchés Financiers (“AMF”) has reinstated its GECO database, providing non-French firms with an online extranet for regulatory reporting and access to information on foreign funds authorised in France.
Australia – Registration and Licensing Relief
In Australia, foreign financial service providers continue to benefit from extended regulatory relief.
The Australian regulator has confirmed that both sufficient equivalence relief and limited connection relief from Australian Financial Services Licence requirements will remain in place until 31 March 2027. This extension follows proposed legislative reforms that may ultimately reshape the licensing framework for foreign providers.
